Is it legal to have my baby in the United States?
The US Constitution, 14th Amendment, guarantees citizenship to all born within the USA regardless of the parents nationality.
What do I need to legally enter the United States?
You will need the normal documentation such as your Passport, Visa and possibly proof of economic solvency this shows you have enough money to cover all cost of the trip and your delivery here, we can provide a receipt to aide in this process if desired (See U.S. Visas Web Site ). It is important to be honest, travel on a tourist Visa, accept no United States social services, and pay all bills in full to assure retaining your personal Visa.
How long does it take to receive all my baby’s legal documents so we may return home?
Generally it takes about 10 – 14 days, to receive your legal birth certificate, which may be obtained at the El Paso County Clerks Office of Vital Records for $23.00 USD (See the El Paso County Clerk: Certified Copies – Birth, Marriage, Death Certificates Web Site).
Once you have a certified copy of your baby’s birth certificate you can go to the US Passport Agency and apply for an expedited passport which may take a few days (See the U.S. Passports & International Travel Web Site ).
You will also receive, from us, a gift birth certificate (not legal) with your baby’s foot prints, copies of all costs paid in full and any other documentation that may aide in your return home.
